Welcome to Arisa Blooms (“Arisa Blooms”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, online store, products, and related services (collectively, the “Services”).

By using our Services or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our Services.

1. ELIGIBILITY

You must be at least the age of majority in your province, state, or country of residence to use our Services or place an order.

If you are using the Services on behalf of another person or business, you confirm that you have authority to bind them to these Terms.

2. PRODUCTS AND SERVICES

Arisa Blooms sells floral arrangements, bouquets, plants, gifts, and related products.

We make reasonable efforts to accurately display product descriptions, colours, sizes, and images. However:

  • flowers are natural products and may vary in colour, size, bloom stage, and appearance;

  • screen settings may affect colour display;

  • containers, wrapping, and decorative materials may vary.

All products are subject to availability.

3. FLORAL SUBSTITUTIONS

Due to seasonal supply, weather, market availability, or quality standards, certain flowers, greenery, containers, or accessories may be substituted with items of equal or greater value.

We will make reasonable efforts to preserve the overall style, colour palette, and value of the arrangement.

4. ORDERS

Placing an order is an offer to purchase. We reserve the right to accept, decline, limit, or cancel any order at our discretion, including for suspected fraud, pricing errors, stock shortages, or delivery limitations.

An order is accepted only when payment is authorized and we send confirmation.

If we cancel an order after payment, we will issue an appropriate refund.

5. PRICING AND PAYMENT

All prices are listed in Canadian Dollars (CAD) unless otherwise stated.

Prices do not include applicable taxes, delivery charges, customs fees, or other charges unless specifically stated.

You agree to provide current, complete, and accurate billing and payment information.

We reserve the right to correct pricing errors and cancel affected orders.

6. DELIVERY

6.1 Delivery Times

Delivery times are estimates only and are not guaranteed unless expressly stated.

Same-day delivery may be subject to:

  • order cutoff times

  • recipient availability

  • weather conditions

  • traffic delays

  • courier capacity

  • product availability

6.2 Customer Responsibilities

You are responsible for providing accurate delivery information, including:

  • recipient name

  • address

  • buzzer/unit number

  • phone number

  • delivery instructions

We are not responsible for failed or delayed delivery caused by inaccurate or incomplete information.

6.3 Recipient Unavailable

If the recipient is unavailable, we may:

  • leave the order in a safe location;

  • leave with concierge/reception;

  • contact recipient;

  • reattempt delivery for an additional fee.

6.4 Risk of Loss

Subject to applicable law, responsibility for products passes upon successful delivery.

7. PERISHABLE GOODS

Flowers and plants are perishable goods. Longevity depends on care, temperature, sunlight, handling, and environment.

We do not guarantee lifespan beyond delivery except where required by law.

Care instructions should be followed to maximize freshness.

8. RETURNS AND REFUNDS

Because floral products are perishable and customized, returns are generally not accepted after delivery.

If your order arrives damaged, defective, or materially incorrect, please contact us within 24 hours of delivery with photos and order details.

Where appropriate, we may offer:

  • replacement

  • store credit

  • partial refund

  • full refund

Refund decisions are made reasonably at our discretion and subject to applicable consumer law.

9. INTELLECTUAL PROPERTY

All website content, logos, branding, text, photos, graphics, product descriptions, and designs are owned by or licensed to Arisa Blooms and protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, modify, scrape, or commercially exploit any content without written permission.

10. PROHIBITED USES

You agree not to use the Services:

  • unlawfully or fraudulently;

  • to violate any law or regulation;

  • to infringe intellectual property rights;

  • to upload malware or harmful code;

  • to interfere with website security;

  • to impersonate another person;

  • to spam or harass others;

  • to scrape data or use bots without permission.

We may suspend or terminate access for violations.

11. THIRD-PARTY SERVICES

Our website may use Shopify and other third-party providers for hosting, payments, analytics, delivery tools, and communications.

We are not responsible for third-party services beyond our reasonable control.

Your use of third-party services may also be subject to their terms and privacy policies.

12. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, our Services and products are provided “as is” and “as available”.

We do not guarantee uninterrupted website availability or that products will meet every subjective expectation.

Nothing in these Terms excludes rights that cannot legally be excluded under applicable consumer protection laws.

13. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Arisa Blooms shall not be liable for indirect, incidental, special, or consequential damages, including lost profits, emotional distress, or business interruption arising from use of the Services or products.

Our total liability relating to any order shall not exceed the amount paid for that order.

Nothing in these Terms limits liability where such limitation is prohibited by law.

14. INDEMNITY

You agree to indemnify and hold harmless Arisa Blooms from claims, damages, liabilities, and expenses arising from:

  • your misuse of the Services;

  • your violation of these Terms;

  • your breach of law or third-party rights.

15. PRIVACY

Your use of our Services is also governed by our Privacy Policy.

16. CHANGES TO TERMS

We may update these Terms from time to time. Updated Terms become effective when posted on our website.

Continued use of the Services after changes means acceptance of the revised Terms.

17. GOVERNING LAW

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

Any disputes shall be subject to the courts of Ontario, Canada.
